### 01. Introduction The Fundación Selección Colombia (hereinafter, "the Foundation") is organizing a donation campaign (hereinafter, "La Lucha") with the goal of raising funds for the SOMOS Equidad project in seven territories of Colombia: Corinto (Cauca), La Gabarra, Cúcuta, and Ocaña (Norte de Santander), Soacha (Cundinamarca), Cali (Valle del Cauca), and Barranquilla (Atlántico). Users who contribute an amount equal to or greater than COP $80,000 will receive a basic urban version lilac cotton t-shirt alluding to the "La Lucha" campaign as a thank you for their donation. Users who contribute COP $160,000 or more will receive a sports material football version lilac t-shirt alluding to the "La Lucha" campaign. For this purpose, the Foundation has made available the donation website for La Lucha to the public. These terms of reference, together with our privacy policy, apply to all persons visiting our website, collectively referred to as "site users". In these terms, the terms "you" and "user" refer to site users. Before using the website, please read these terms and conditions of use. By using this website, you expressly declare acceptance of the terms of reference and agree to use the website and services in accordance with the law and this legal notice. Any action that could harm or prejudice the rights and interests of the Foundation and third parties is prohibited. ### 02. Usage Instructions People who make donations to the campaigns will receive a donation letter via email confirming their support, containing basic user data (name, surname, ID number, phone number, address, email, and the value of the donation made). If you need your donation certificate, please send an email to lalucha@fundacionseleccioncolombia.org with a copy of your ID and a copy of the RUT. ### 03. Reservation of Rights Property of Fundación Selección Colombia. The website contains a variety of content, such as information, software, illustrations, text, video, audio, images, logos, and more. All this content, along with associated intellectual property rights, belongs to the Foundation and its licensors. These materials are protected by copyright and other intellectual property laws or are included under "fair use" principles. The Foundation retains full ownership and rights over the website. The trademarks appearing on this website are registered trademarks of the Foundation. It is important to note that references to our products, services, and trademarks on this website are not a comprehensive representation of our rights. Access to the website does not grant you any rights other than the ability to view the content. Please note that placing this website online does not provide a license to use the mentioned trademarks. Any use of these trademarks requires prior written permission from the trademark owner. The Foundation wishes to inform users that they have the right to access, rectify, and delete their personal data. Copyright Reproduction or representation in any form or extent without prior explicit written permission from the Foundation is strictly prohibited and considered illegal. Violation of this restriction constitutes copyright infringement which may result in civil and criminal liability for the responsible individual. The Foundation recognizes and defends others' intellectual property rights and expects our users to do the same. ### 07. Data Processing Responsibility The FUNDACIÓN SELECCIÓN COLOMBIA identified with NIT. 900.784.772 – 6 is a private legal entity organized as a non-profit organization. ### 08. Applicable Data Processing Legislation - Colombian Political Constitution, articles 15 and 20. - Law 1266 of 2008. - Law 1581 of 2012. - Decree 1377 of 2013. - Unified Decree 1074 of 2015. - Decree 090 of 2018. - Constitutional Court Rulings C – 1011 of 2008 and C – 748 of 2011. - Circular 003 of 2018 issued by the Superintendence of Industry and Commerce. - Guides and booklets issued by the Superintendence of Industry and Commerce. ### 09. Scope of Data Processing Application This policy will apply to anyone supplying personal data to the Foundation as a processor or controller within or outside national territory. ### 10. Data Processing and Purposes The personal data collected will be included in institutional databases. ### 11. Sensitive Data Processing Sensitive data may be used and processed when: a) The user has given explicit consent for such processing unless otherwise required by law. b) The processing is necessary to safeguard the user's vital interest when physically or legally incapacitated; in such events, legal representatives must give authorization. c) The processing pertains to data necessary for recognizing, exercising, or defending a right in judicial proceedings. d) The processing has historical, statistical, or scientific purposes. ### 12. Participation Conditions Participation conditions in the donation campaign are as follows: - To be eligible to receive a t-shirt, users must meet these criteria: be of legal age and reside in Colombia or Latin America. - All donations must be made using Colombia's official currency, Colombian peso (COP). - Users must provide their name, surname, ID number, phone number, email address, and a valid address within Colombia or Latin America. ### 13. T-shirt Delivery T-shirt delivery will occur as follows: - The Foundation commits to sending the t-shirt within approximately twenty (20) business days after receiving the donation. - If t-shirts are not available at that time, delivery may be delayed up to thirty (30) business days. - The Foundation is not responsible for delivery delays caused by circumstances beyond its control such as postal service delays or public order situations affecting transportation routes. ### 14. Refunds and Returns Policy Donations made to the Foundation are non-refundable. However, if a defective t-shirt is received, users must contact the designated Foundation liaison (lalucha@fundacionseleccioncolombia.org, +57 3237205466) within eight days after receiving the t-shirt to coordinate the replacement process. ### 15. Limitation of Liability The Foundation assumes no responsibility for any indirect, special, or consequential losses or damages that may arise in connection with this Campaign. ### 16. Applicable Law and Jurisdiction These terms of reference will be governed and interpreted in accordance with applicable legislation mentioned above as well as any other current law in Colombia. Any dispute arising in connection with these terms will be subject to the exclusive jurisdiction of Colombian courts. ### 17.
